Overweight? Underpaid? See You In Court!
Discrimination comes in all shapes and sizes . Discrimination cases that have crossed my desk include myriad examples of how overweight can equal underpaid.
According to the law, you cannot discriminate against your employee for reasons of mental or physical disability, race, sex or age. But many people don't realize that certain practices that are done every day are discriminatory and illegal.
One case, Pat, a perfume saleswoman in a New York City store was denied the best counter locations, i.e. counters with high volume, that generally were assigned by seniority. She was told by the store owner that when she lost thirty pounds, she could have the coveted front counters.
The case was brought to the State Human Rights Commission, the first step in an arduous battle for equal rights for the overweight saleswoman.
Other discrimination cases I have worked on include representing an account executive fired after becoming pregnant by her supervisor, and a gentlemen fired after finding out he had a mental illness even though he was fully capable mentally and physically to do his job as an accountant.
