Cecile C. Weich says, basically in America a prenuptial Agreement is a device for men to exploit women. This is because in most cases, it's the men who have the wealth. But not always. Weich is quick to point out that many of her clients are older successful women, marrying younger, less successful men.
What's also becoming more and more common, according to matrimonial lawyers, is a prenuptial agreement negotiated and non-financial points such as the religious training of the prospective offspring, housekeeping obligations - even the frequency of sex. Weich calls these "consciousness-raising issues", but warns her clients that Judges are often reluctant to take them seriously. Weich also urges her clients to stick to what's important - namely money. "I had one client who wanted specifically that the spouses have different bathrooms. I wouldn't do it.
When the negotiations are simple and straightforward, a prenuptial agreement can cost as little as a few hundred dollars. Complicated deals, however, can cost in the thousands, many thousands.
